He was wanted by deputies for events that happened the night of June 16 that involved him with alleged burglary, false imprisonment and conspiracy to commit a crime, according to the arrest report. The arresting officer observed a Cadillac Seville as a vehicle Silva had been seen in recently and a man who is a close friend of Silva. The deputy called for backup as the man entered into an apartment on David Street.
Wen the cover officer arrived, deputies conducted a knock and talk of the apartment. Deputies observed through the window of the front door, both the man and Silva sitting on a sofa in the front room of the apartment. Deputies knocked on the front door and silva was observed walking into a hallway north of the living room area. Deputies knocked on the door a second time and asked the man if he had seen Silva. The man responded Silva was sleeping in the bedroom.
The officer then asked the man if he could enter the apartment. The man said yes and stated "let me get him for you" according to the arrest report. The officer observed the man approach a closed bedroom door located on the north east corner of the apartment. The officer heard the man say "Nyle the police are here to speak to you" according to the arrest report.
The officer observed Silva on the bed with his eyes closed. The officer approached Silva and placed handcuffs on his left wrist. The officer informed Silva that he was being detained and assisted him with putting on shirt and shoes.
Silva was read his Miranda rights and was asked if he was willing to answer questions. Silva told deputies yes. He stated that he was helping out a friend by giving rides to pick up property. He originally stated he did not know anything that happened and that he gave a ride to ride to friends but claimed no knowledge of thefts and assaults that he was wanted for, according to the arrest report.
While the arresting officer was speaking with Silva, he noticed a skateboard matching the description of the one taken from the victim. The officer asked Silva if he owned the skateboard. Silva stated yes, according to the arrest report.
The officer asked him where the skateboard came from. Silva said he didn't remember. The officer then asked Silva if he could describe the other individuals that were in the car with him. Silva stated he did know one person and named his first name and alias.
The officer asked Silva again if he had any property in the apartment that didn't belong to him. He stated yes, and told deputies where to find an MP3 player and a shirt that belonged to the man he just named. The items were located and booked as evidence.
