A vigilant motorist who saw a vehicle drive on a sidewalk and couldn't maintain a single lane of traffic early Wednesday morning resulted in the arrest of a 29-year-old construction worker who faces charges of driving under the influence of prescription drugs.
Kip McNabb of Dayton was arrested in the 2500 block of Carson Street after he parked his Ford F150 in two spaces and began walking through the halls of Harbor Freight. Earlier the eyewitness reported to sheriff's dispatch that McNabb had driven along a sidewalk in front of Del Taco in the 800 block of College Parkway and then nearly collided with several vehicles as he continued to drive.
The arrest report filed by deputies said that once they found McNabb he was "staggering in the halls and appeared to be walking like a zombie."
When contact was made, he appeared to "be in the nod" with his eyes droopy red and watery, according to the arrest report. McNabb was using his arms to hold on the aisle as he walked and his speech was slurred. Deputies had to ask McNabb his name several times because his speech was hard to understand. McNabb told officers that the Ford 150 parked in the lot did belong to him, according to the arrest report.
Deputies asked McNabb to walk out to his vehicle. That's where the witness who called dispatch to report the vehicle, was waiting with other officers so that she could provide a positive identification of the vehicle and McNabb.
A Nevada Highway Patrol trooper arrived at the scene and recognized McNabb from a prior DUI drug arrest a few weeks ago. McNabb was asked if he had any weapons. According to the arrest report he tried to reach for a multi-tool set near his front right pants pocket. He gave deputies consent to search him and the officer removed a small flash light from McNabb's right pants pocket. The flashlight rattled when shook and so the deputy opened it and saw several types of prescription pills inside. The officer counted 30 prescription tablets. Among the drugs found were Soma, Oxicodone, Adderall, an amphetamine; and Norco, an acetaminophen. McNabb said he did not take any medications, according to the arrest report.
According to the arrest report, McNabb had severe dry mouth with a white pasty substance surrounding his lips. When he blinked his eyes he appeared to keep them closed for second as if he was falling asleep while officers spoke with him, according to the arrest report. McNabb told officers "I'm really screwed up" also kept referring to the arresting officer as "your honor" while responding to questions.
McNabb said he was on several types of medications, saying that he took four "Soma" two Adderall and one Oxicodone at 10 Wednesday morning, according to the arrest report. McNabb then said he had a prescription. But the pills found in the flashlight were not in their original prescription medication prescription bottle. There was no way to confirm if the medication in the flashlight was prescribed to McNabb, according to the arrest report.
McNabb said he could not participate in a field sobriety test because of an injury to his right leg. He said he was taking all the prescription medications because of his injured leg. A Dreager Drug Test was performed on him and the test returned positive for opiates and amphetamine.
Dispatch confirmed McNabb had a recent DUI arrest with no conviction, the same arrest noted by the Nevada Highway Patrol trooper. It had not gone to trial yet, according to the arrest report.
McNabb faces a felony possession of prescription drugs without a prescription, driving under the influence of drugs and failure to maintain a single lane. His bail is set at $3,739.
