Former City of Angels 2 pot club owner Gennaro "Gino" DiMatteo of South Lake Tahoe was sentenced to 5 years in federal prison Wednesday by U.S. District Judge Kimberly J. Mueller.

DiMatteo had pled guilty to a felony for marijuana trafficking on Jan. 9. As part of his plea agreement, DiMatteo agreed to forfeit more than $40,000 to the United States.

Below is a news release issued Wednesday by the U.S. Justice Department.

SOUTH LAKE TAHOE DISPENSARY OWNER SENTENCED TO FIVE YEARS IN FEDERAL PRISON AND AGREES TO FORFEIT DRUG PROCEEDS

SACRAMENTO, Calif. — United States Attorney Benjamin B. Wagner announced that Gennaro DiMatteo,
43, of South Lake Tahoe, California, was sentenced to 5 years in federal prison today by United States District Judge Kimberly J. Mueller. DiMatteo had previously entered a guilty plea to a felony for marijuana trafficking on January 9, 2013. As part of his plea agreement, DiMatteo agreed to forfeit more than $40,000 to the United States.

This case is the product of an extensive investigation by the El Dorado County Sheriff’s Department, the El Dorado County District Attorney’s Office, and the Sacramento District Office of the Drug Enforcement Administration. Assistant U.S. Attorneys Jason Hitt and Todd Pickles prosecuted the case.

According to facts admitted by Mr. DiMatteo during his guilty plea before Judge Mueller, during a search of Mr. DiMatteo’s South Lake Tahoe residence, agents discovered a hidden door that led to several sub-surface rooms under the structure.

The rooms had been set up with equipment that is standard for indoor marijuana cultivation gardens. Detectives discovered approximately five pounds of processed marijuana in one of the sub-surface rooms. In the downstairs/basement area, detectives found a scale located on a silver table near a food saver machine. These items are consistent with Mr. DiMatteo heat sealing marijuana after weighing out distribution quantities and shipping them out of state.

The heat sealing of the marijuana can have the effect of concealing and disguising the odor from marijuana. In total, detectives seized approximately 5 pounds of processed marijuana and 15 pounds of marijuana “shake,” that is, residual marijuana used for cooking marijuana edibles. During questioning, Mr. DiMatteo admitted that he is not a user of marijuana. Inside a freezer within Mr. DiMatteo’s detached garage, detectives located marijuana-laced ice cream, granola bars, and pizzas. Within a desk inside the kitchen area, as well as inside a desk in the living room area of Mr. DiMatteo’s residence, detectives found pay/owe sheets. In particular, Mr. DiMatteo had notes setting the price of the marijuana sold at a South Lake Tahoe marijuana dispensary known as “City of Angels II.” On a separate set of documents, Mr. DiMatteo listed the various amounts paid. Mr. DiMatteo lists himself receiving $7,000 bi-weekly. As part of his Plea Agreement, Mr. DiMatteo specifically admitted that he possessed the marijuana seized from his residence on August 31, 2012, with an intent to distribute it to others.

When prosecuted in federal court, drug traffickers typically receive much harsher sentences. In addition to the longer sentences imposed, unlike state court prisoners who are released early on parole, there is no early release on parole in the federal system.

UPDATE: A South Lake Tahoe woman faces felony charges of evading, assault with a deadly weapon, driving under the influence and driving on a suspended license after leading officers on a chase from Carson City to South Lake Tahoe on Sunday.

Two Carson City Sheriff's Office deputies were treated and released for minor injuries they sustained after the driver, Samantha Randazzo, 32, rammed a patrol vehicle and then refused to get out of the SUV she was driving, said Carson City Sheriff's Office Sgt. Earl Mays.

A deputy suffered injuries to his hand when he broke through the passenger side window to unlock the door. The other deputy was treated and released for injuries after the woman slammed into his patrol vehicle, said Mays. The names of the deputies were not available.

The chase began before 6 p.m. on South Carson Street near Carson Station. A deputy attempted to pull Randazzo over for driving erratically and suspecting she was under the influence. Randazzo instead continued driving south on Carson Street and then westbound onto Highway 50 over Spooner Summit. Officers in the pursuit said she traveled at a speed of around 55 mph in town and 70 mph up Spooner through light traffic. Douglas County Sheriff's Office and the Nevada Highway Patrol also responded.

Because of traffic in the South Lake Tahoe area, Randazzo was forced to reduce her speed to 35 mph to 40 mph. According to Sgt. Shannon Laney of the South Lake Tahoe Police Department, Randazzo hit about 50 mph as she went through the intersection of Highway 50 and Ski Run Boulevard.

The chase finally ended with an arrest at the corner of Highway 50/Lake Tahoe Boulevard and Tallac Avenue in South Lake Tahoe. The vehicle was stopped after it rammed the Carson City patrol officer's vehicle at around 6:20 p.m., said Laney.

A car stopped at a red light on Highway 50 and Tallac Avenue caused Randazzo to stop so a Carson City Sheriff's officer was able to pull his car in front of her. She slammed into his vehicle in an attempt to escape but was unable to do so, said Laney.

Carson City man receives two maximum sentences for meth, marijuana sales

A 43-year-old Carson City man was sentenced Tuesday in district court to two maximum sentences for two separate felony drug transactions.

Lamont Ontario Williams received 28 months to 6 years for the sale of methamphetamine and a consecutive term of 28 months to 6 years for the sale of large amounts of marijuana, according to the Carson City District Attorney's Office. As a result, Williams will spend a minimum of 56 months and up to 12 years in prison, which is the maximum sentence for both cases.

At sentencing in Carson City District Court, the defense argued that Williams sold narcotics to support his addiction to marijuana and that he should receive an opportunity to address his drug use through treatment. District Court Judge James T. Russell relied upon Williams’ extensive criminal history, which included 6 felonies and 42 misdemeanor convictions, and sentenced Williams to the maximum sentence for these two incidents, according to a news release.

Russell further stated that the Williams could not meet the slightest direction from the court, and as a result, he was not a good fit for probation.

“These cases once again demonstrate our zero tolerance for those who sell drugs in our community,” said Neil A. Rombardo, District Attorney. He went on to state, “The D.A.’s Office supports rehabilitation where appropriate, but not for those who deal narcotics to support their habits, and in this case, rehabilitation was inappropriate.”

A back up officer arrived and an exterior sniff of the vehicle was made by K9 Rex that resulted in a positive for narcotics, the arrest report states.

The interior of the vehicle was searched and a small black zipper case in the glove compartment was found to have a hypodermic device with a significant amount of brown liquid inside that tested positive for heroin. Senate Hears Bill That Would Allow Guns On College Campuses

By Andrew Doughman / Nevada News Bureau
CARSON CITY – When Amanda Collins testified before a Senate committee, she recounted an emotional story of her brutal assault at University of Nevada, Reno campus.
Collins said she was defenseless when serial rapist and convicted murderer James Biela attacked her in a UNR parking garage.

She was testifying in support of a bill from Sen. John Lee, D-North Las Vegas, that would allow people with concealed carry permits to bring their firearms onto Nevada’s college and university campuses.
Collins had a permit to carry a concealed firearm, but had left it at home knowing that it was illegal to carry her weapon onto campus.
“The unanswered question of my life is and will remain to be, ‘what would have changed if I was carrying my weapon that night?’” she said.
Earlier this summer it took a Nevada jury just six hours to convict Biela of the rape and murder of Brianna Denison. Biela was also found guilty of three other felony charges, including the rape of a Collins in October 2007 and the rape and kidnapping of another woman a few months later.
In her testimony this morning, Collins raised a question that guided the several hours of testimony that followed: “what if?”
Gun advocates, firearms safety businesses and students said people must pass rigorous requirements to obtain a permit to carry a concealed weapon; they know the law and would not misuse their firearms. If firearms are allowed on campus, people on campus would be more safe, they said.
“It’s important to know that law-abiding citizens are just that: law abiding,” Lee said.
Furthermore, the senator said, the current ban creates an “arbitrary line” between on-campus and off-campus that oftentimes is no more different than one side of the street from the other.
Assemblyman Scott Hammond, R-Las Vegas, teaches night classes at the University of Nevada, Las Vegas. He said that his students sometimes do not feel safe leaving his class.
“They are very cognizant of the fact that there are places around the campus that are not the safest,” he said.
Hammond said would feel safer if trained permit carriers were in his classes.
Hours of testimony from individuals provided the committee with a series of situations. If “bad guys” were to attempt violent acts on campuses, the ability to carry a firearm on campuses would allow people to protect themselves.
“To single out college students and staff and leave them more vulnerable than the rest of the population just seems unfair,” said Scott Durward, a firearms trainer for Blackbird Tactical Training in Reno.
Adam Garcia, police chief at UNR, said that campuses are safer than the surrounding community. But in regards to Collins, who was still in the room when Garcia testified, he said “we failed miserably.”
Garcia and other representatives from police departments throughout Nevada opposed the bill, saying it would make campuses less safe if guns were to be allowed. He said raucous sporting events involving alcohol and firearms could pose a security threat.
“These events could become killing fields,” Garcia said.
Frank Adams, representing the Nevada Sheriffs and Chiefs Association, said that the bill poses “grave concerns.” If guns were to be allowed on campuses, he asked the committee what procedures police would follow in terms of storing guns in dormitories and managing guns at sports events.
He also said that Nevada’s Board of Regents generally govern their own affairs. This bill would be unusual because it instructed the board to act a certain way.
“Many private businesses elect to restrict any weapons, concealed or not,” Adams said.
Jim Richardson of the Nevada Faculty Alliance said that the bill would mandate that universities allow people with permits to carry their guns on campus while not changing laws governing allowing firearms in the Legislature, airports and the other government buildings.
After three hours of testimony, Lee held the bill for further discussion.

A 27-year-old Carson City man faces felony drug charges after being arrested in the parking lot of Walmart Wednesday.

Richard Reid Adams was arrested at 12:21 p.m. According to the arrest report, officers were dispatched to the parking lot after receiving information that it appeared as if someone was attempting to break into a vehicle and had, earlier, went through a back pack located inside the trunk.

Officers arrived and found Adams inside the vehicle, which it was later learned belonged to him, and was sitting on the driver's side. He was asked to open the door. When he did officers observed a hypodermic needle in his right hand. He then squirted brown liquid out of the needle onto the ground when the officer told him to put the needle down, the arrest report states.

The arrest report states that he then picked up a spoon that was next to him and wiped it off on his clothing. The man refused to exit the vehicle the first three times he was asked and had to be physically restrained in order for cuffs to be placed on him.

Two men were arrested by Carson City authorities on Saturday after officers discovered heroin and methamphetamine in a car they pulled over because of erratic driving.

Andrew Woodburn, 31, of Carson City, faces charges of felony drug possession for sale; possession of hypodermic needles and drug paraphernalia. Bail was set at $15,000 cash bondable.

Joseph Alex Kendall, 23, of Dayton, faces a felony charge of possession controlled substances — methamphetamine and heroin. Bail was set at $2,500 cash, plus Kendall has an outstanding warrant out of Lyon County.

According to a Carson City Sheriff's Office arrest report, deputies assigned to the Special Enforcement Team were on patrol in the parking lot of Lowe's in the 400 block of Fairview at about 6 p.m. An officer observed a maroon sedan occupied by the men, driving in circles, erratically, in the Pet Smart parking lot and then in the parking lot of Lowe's, according to the arrest report.

Because of the way the driver, Woodburn, was operating the car, the officer suspected drug activity, including blocking, and pulled the sedan over with lights and sirens. The arresting officer observed that Woodburn, the driver, had three hypodermic needles in his lap, some cotton swab tips and a spoon with a handle bent like a cup.

According to the arrest report, the officer identified himself and asked Woodburn, "you aren't a diabetic are you?"

Woodburn said nothing but his hands started heavily shaking, the arrest report stated. The officer asked Woodburn and passenger Kendall not to move and requested a deputy to respond for cover, the arrest report stated.

When the deputy arrived he asked Kendall for consent to search his pockets. Inside the officer found a plastic bag of suspected methamphetamine, that weight approximately .5 grams in his right front pocket, according to the arrest report. Meanwhile, the officer who had observed the paraphernalia on Woodburn's lap, asked the suspect to exit the vehicle.

Both men were placed into custody. The officer read Woodburn his rights under Miranda, which he waived, according to the arrest report.

Officers called for a tow service of the vehicle. During the inventory of the car two backpacks were found in the trunk. Upon inventory, inside a gray backpack there were more hypodermic needles, two prescription bottles filled with prescription pills labeled with Woodburn's name, heroin drug paraphernalia and 14 balloons of suspected heroin, weighing approximately 1.4 grams.

While doing inventory of the cab of the vehicle, a small gray bag, commonly used to carry drug paraphernalia, was found on the passenger's side of the console area that contained three needles and a spoon with brown residue, according to the arrest report.

While the deputy was processing the scene and preparing the vehicle for impound, Woodburn spontaneously admitted all the stuff in the vehicle wasn't his and only the gray bag and what was found in his lap, according to the arrest report. He stated the other confiscated items belonged to Kendall, including the gray bag found in the cab and the black bag. He stated they had both driven there to inject themselves with marijuana in the parking lot because there wasn't much law enforcement there.

The officer ran Woodburn and Kendall through the local records and warrants check, which returned that Kendall had a confirmed warrant out of the Justice Court in Dayton.

Both men were taken to jail separately. Upon arrive at the jail the officer allowed Woodburn to call his mother who he advised in pre-booking that he was caught doing heroin, with a lot in his possession, and that he was going to prison, according to the arrest report.

— The suspects are innocent until proven guilty in a court of law.

Carson City sheriff's officers made felony arrests in two separate cases Friday involving possession of stolen property. In one arrest a man was in possession of an electronic tablet that was allegedly stolen from a Target store in Oregon and the other, a vehicle that was reported stolen Dec. 26.

On Friday, Jan. 3, officers arrested Keenan Massey, 36, on suspicion of felony possession of stolen property. According to the arrest report, officers made a traffic stop on a vehicle for going 46 mph in a 25 mph zone. An officer made contact with Massey who provided insurance and registration information. The officer could smell an odor of marijuana coming from the vehicle and dispatched a K9 to respond to the location.

Massey was issued a citation for speeding. He was asked if he had anything illegal in the vehicle, in which the man replied "No, search it with the dog." Deputy Pullen did an exterior search with K9 Rex, which alerted to a positive on the driver's side door, the arrest report states.

The man advised that when he bought the vehicle there were "roaches" in the ash tray and that he removed them prior to driving it out of state, according to the arrest report. Officers conducted a search of the vehicle. Deputy Pullen advised he located a Samsung Tablet in the center console with a security device still on it. The tablet had "demonstration only" printed on the back. The security device is a large black lock with the securing wire cut.

The man stated on his own free will that he bought the tablet a month ago for $150 from a guy named Alex at a local business. Officers called the owner of the local business who advised that Alex hadn't worked at the store for about 5 years and that he would never sell an item that was "for demonstration only," the arrest report states.

Officers looked through the photos on the device and saw retail store employees taking pictures of themselves. There were also pictures of several random people in the same location. Deputy Pullen ran the serial number of the tablet and did not get a match in the NCIC data base, the arrest report states.

Officers located a cigarette package containing a small amount of marijuana and two Visa cards with a name that was not his. Massey was told his story didn't check out. He then told officers he got it at a pawn shop and has a receipt in his wallet. Officers checked on that too and couldn't see where the tablet was pawned. He was taken to jail. Deputies then learned, after further investigation, that the tablet belonged to a Target store in Salem, Oregon. Officers received a fax from store officials with an incident report and still pictures.

Officers read Massey his Miranda rights and Massey agreed to speak. He stated that he was in Oregon and stopped at a Target store. While he was in the store he was near the tablets. He said he saw a male cut the cable to the tablet and take it from the store. He said the male approached him at his vehicle and offered to sell him the tablet for $20. Massey said he purchased the item knowing it was stolen and left the area. He said he was sorry for lying to officers and said the photos of him in the Target store in Oregon were his.

The property was recovered and booked into evidence. Massey was jailed on charges of possession of stolen property and possession of less than an ounce of marijuana. Bail: $25,732.

In a separate felony case:
John Andrew Zglinski, 51, was arrested Jan. 3, in the 1600 block of Brown Street on suspicion of being in possession of stolen property and a misdemeanor drug paraphernalia charge.

According to the arrest report, Carson City Sheriff's Office deputies responded to Brown Street where Sgt. Cullen was out with a vehicle matching the description of a car stolen in December. Upon arrival officers made contact with Zglinski who was driving a black 1995 Honda Accord.

The vehicle was reported stolen on Dec. 26 after Zglinski failed to return it to his mother, the registered owner. According to the arrest report, his mother attempted to contact him several times to return the vehicle, but he did not.

Officers read Zglinski his Miranda rights and he agreed to speak. He said his mother left him three voice mails to return the vehicle but he did not answer any of them or return the vehicle.

When asked why he did not return his mother's calls or the vehicle, he said he didn't have an answer for that and that he was just being a "butthead" and downright selfish, the arrest report states. Officers asked Zglinski if he knew his mother was in the hospital and the man said he did but had not gone to visit her, the arrest report states.

During a pat down search, officers found a small marijuana pipe in the front coin pocket of the man's jeans. He advised the officer beforehand that he had a pipe in his possession.

The vehicle was returned to the man's mother. Zglinski faces a felony charge of possession of stolen property and a misdemeanor charge of possession of drug paraphernalia. Bail: $26,132.

Those arrested and facing charges are innocent unless proven guilty in a court of law.

According to the arrest report, at about 5:45 p.m. on Thursday, the woman was seen leaning on the glass doors at the Carson City Sheriff's Office on Musser Street. The woman appeared to be distressed and an officer asked her what was wrong.

According to the narrative provided by the arresting officer the woman told the officer that she had done something wrong and wanted to turn herself in. The officer asked her what she had done. The woman replied that on the previous night she had stolen a person at the Horseshoe Club.

The officer asked if she would like to speak about it and the woman agreed. She went inside the lobby of the sheriff's office and the arresting officer read her the Miranda rights. Owens agreed to speak, according to the report.

The woman said that she had been inside the Horseshoe Club the previous night and stole another woman's purse. As she left the casino, she said she went to the Nugget and met with a friend and showed her the purse. The female friend and Owens checked the person and found a cell phone in which she threw away, the report stated.

The two then left the casino and went to a liquor store on Winnie Lane where the two purchased some alcohol and cigarettes. Later the two left the location and went to the friend's house at 20 College Parkway. While on the way to the last location of the liquor store, the friend demanded from Owens some of the large amount of cash in the victim's purse. The friend collected about $200 from the proceeds as she asked for "her cut" according to the arrest report.

The pair began drinking and smoking near the friend's apartment when Owens walked over to the North Carson Save Mart where she bought several items. Owens then paid for the items with her food stamps and some of the cash from the victim's purse, according to the arrest report. Owens estimated the amount of cash in the purse to be between $500 and $600.

The woman told police that she went home at which time she found a deputy's business card on the kitchen counter. In the morning, after speaking with her daughter, she realized that after the incident, deputies had already identified her as the suspect and had gone to her house where they questioned the woman's daughter, according to the arrest report.

During the day, Owens said she thought about turning herself in. She also said she had called and left a message for the first responding deputy, according to the report. During the interview, Owens continuously admitted that stealing the purse was wrong and said she was ready to take her punishment, the arrest report stated.

Based on the woman's admission, positive identification and producing the stolen purse minus about $300 cash, Owens was arrested and booked into jail for felony grand larceny, the arrest report stated. During the interview, the woman denied having used any of the victim's credit cards or personal checks, the arrest report concluded.
