According to the deputy's report, Diaz went off on racist tirades about white people and white cops during the interview.

Diaz had initially stated the victim tells the truth, according to the report, but then quickly recanted and stated the victim had become a liar ever since getting together with his girlfriend.

Diaz later was found standing up and facing the wall of the interview room with his feet spread apart and his hands up in the air. He told the deputy he knew he was going to be arrested and did not want to give police the opportunity to shoot and kill him.

Diaz was handcuffed and arrested at that point. Once in custody, though, the suspect went off on more rants on racism, getting highly agitated and calling the arresting deputies names, the report said. Bail: $40,000.

Man who stalked Carson City judge sentenced to prison on weapon charges

The man accused of firing shots into the home of Carson City Judge John Tatro, and later attempting to firebomb his residence, was sentenced to prison Tuesday following his conviction on felony weapons charges from 2011.

Judge James Wilson sentenced John Thomas Aston, 73, to prison terms of 12 to 32 months and 16 to 40 months on the two offenses to be served consecutively.

The sentences follow Aston’s convictions in June for carrying a loaded revolver concealed in his waistband without a concealed carry permit and for having a sawed-off shotgun in his vehicle. Officers also discovered three additional firearms, hundreds of rounds of ammunition, holsters, knives, cash, binoculars, and a map of northwestern Nevada in Aston’s car following his 2011 arrest. The convictions in this case are not related to the accusations involving Tatro.

Carson City District Attorney Jason Woodbury and Assistant D.A. Kristin Luis prosecuted the case. Bill Murphy, Chief Trial Deputy for the Nevada Public Defender, represented Aston.

Woodbury urged Wilson to send Aston to prison, stating Aston “created an extremely dangerous situation” by “actively resisting” a law enforcement officer while armed with loaded firearms. Woodbury also emphasized Aston’s six-year evasion of a bench warrant issued after he jumped bail in the case, arguing “every day during those six years was an opportunity to do the right thing” and turn himself in to face the charges. Aston’s attorney asked for lenience.

“He was just confused,” Murphy argued, saying Aston was trying to cooperate with deputies on the scene, but they were giving conflicting instructions. “If he had intended to do any harm to any officer there, he had the opportunity to do so,” Murphy added, crediting his client for resolving the incident before it “spun out of control.” Aston also made a statement, calling the case “a travesty of justice.” Aston said he understood how the officer might have believed he was reaching for a weapon during the encounter, but felt his arrest was the result of “sloppy police work.” Aston explained the multiple firearms were in his car because he was trying to sell them.

At the conclusion of the hearing, Wilson declined Aston’s request for probation. Indicating he considered “all of the information,” Wilson explained that Aston’s “absconding takes this, in the court’s view, out of a probation case.”
A preliminary hearing is scheduled to begin Sept. 6 on the three felony charges involving Tatro. Woodbury said he and Luis will prosecute that case as well.

A man was arrested Saturday morning in the 800 block of Terrace Street for suspicion of felony burglary, a Carson City sheriff's deputy said, after a neighbor reported suspicious activity at the residence.

Christopher Sturgis, 27, of Santa Clara, Calif., was taken into custody at 8:33 a.m. after being discovered sleeping naked by a sheriff's deputy inside a home that had been broken into.

According to the arrest report, a reporting party was watering plants at the residence while its owners where out of town when she noticed a broken rear window into the house.

Upon arrival, the responding deputy observed the broken window and also made note of a large rock inside the residence. The rock was visible from outside of the home, the report said. From outside, the deputy could also see items inside the home, which appeared to be ransacked.

At that point, the deputy attempted to clear the house. A naked male, later identified as Sturgis, was found sleeping in an upstairs bedroom, the report said.

Upon contacting Sturgis, the deputy observed he seemed to be suffering from a mental illness, the report said, appearing "out of it" and displayed a blank stare.

Sturgis waived his Miranda rights and agreed to speak with law enforcement, stating he was worried about his grandmother and had decided to break into the house.

Sturgis admitted to taking food out of the refrigerator, the report said, eating some of it and discarding other pieces of food. He also reported vomitting on the living room floor and in the upstairs bedroom.

Sturgis identified his grandmother by name, but it did not match the names of the victims who owned the home Sturgis was in. The deputy reported that Sturgis appeared to have broken into the wrong house.

In talking with the male suspect, the deputy reported smelling an alcohol odor on his breath.
